West Virginia Adult Day Care Information

West Virginia licenses medical adult day care centers as a type of ambulatory health care center. Only those clients who would benefit from the adult day care program may be admitted or allowed to continue. Participants may be discharged if they require specialized institutional care, demonstrate sufficient improvement to enable them to live more independently or if they develop behavioral problems that may be disruptive to staff members or fellow participants

West Virginia Adult Day Care Minimum Standards

West Virginia requires a staff to participant ratio of 1:6. If a participant’s physician indicates, in writing, that the client is allowed to administer their own medication, then they may do so. If medications and treatments are not self-administered, then a nurse or physician must do so. The same person who prepared the doses for administration shall administer drugs to those participants who do not self-administer their medication.

All participants receiving services in the center have a right to be free from unnecessary or excessive medication. In addition, medication shall not be used on participants in an attempt to restrain them. Any center that is regulated according to these rules can expect to have an unannounced inspection at least once a year. The Department of Health has the authority to provide for inspections or investigations as deemed necessary.

As a part of the Aged & Disabled Waiver Program, medical adult day care services may be offered.
